TERMS & CONDITIONS
These Booking Terms & Conditions apply to all cycling holidays, tours and trips organised by DAVE SCOTT COACHING LTD ("we", "us" or "our").
Please read these terms carefully before making a booking. By making a booking and paying a deposit, you confirm that you have read, understood and accepted these terms on behalf of yourself and, where applicable, all members of your booking.
1. Booking
A booking is not confirmed until we have received the required deposit and issued written confirmation of your booking.
The person making the booking must be at least 18 years old and is responsible for ensuring that all members of their party are aware of and accept these Terms & Conditions.
You are responsible for checking that all details on your booking confirmation are correct and must notify us promptly of any errors.
2. Deposit and Payment
A deposit will be required at the time of booking.
The deposit represents our reasonable costs and commitments in arranging and reserving your holiday and is non-refundable where you choose to cancel, except where these Terms & Conditions or applicable law provide otherwise.
The remaining balance must be paid no later than 12 weeks before the departure date.
If a booking is made within this period, the full holiday price is payable at the time of booking.
If the balance is not received by the due date, we reserve the right to treat the booking as cancelled by you and apply the cancellation terms below.
Customers who are an active coached client with us at the time of booking a trip, and who remain an active coached client on the trip commencement date, may be eligible for a coached client discount.
The availability and value of any discount will be as stated on the relevant trip booking page or promotional material at the time of booking and may vary between trips. Where no coached client discount is stated for a particular trip, no discount will apply.
To qualify for the discount, the customer must continue to meet the applicable coached client eligibility requirements up to and including the commencement date of the trip. If the customer ceases to be an active coached client before the trip commencement date, we reserve the right to withdraw the discount and require payment of the difference between the discounted price and the standard trip price.
3. Cancellation by You
If you wish to cancel your booking, you must notify us in writing by email.
Cancellation will take effect from the date we receive your written notification.
Because we incur costs and make commitments to accommodation providers and other suppliers in advance, cancellation charges may apply. Unless otherwise stated at the time of booking, the following cancellation charges apply:
Less than 12 weeks before departure: 100% of the total holiday price.
Cancellation charges are intended to reflect the costs and losses we reasonably incur as a result of the cancellation, taking into account any costs we are able to recover or avoid.
We strongly recommend that you obtain appropriate travel insurance which includes cancellation cover from the date you make your booking.
4. Changes by You
If you wish to make a change to your booking, please contact us as soon as possible.
We will make reasonable efforts to accommodate requested changes but cannot guarantee that this will be possible.
Any additional costs charged by hotels, transport providers, bike hire companies or other suppliers as a result of the change will be payable by you.
Requests to transfer a booking to another person will be considered subject to availability, supplier conditions and any applicable legal rights.
5. Cancellation or Changes by Us
Cycling holidays can be affected by circumstances outside our control, including weather, road closures, local events, safety concerns, accommodation availability and other unexpected circumstances.
We therefore reserve the right to make reasonable changes to routes, accommodation, timings, activities and itineraries where necessary.
If we are required to make a significant change to your holiday before departure, we will inform you as soon as reasonably possible and explain the options available to you.
In exceptional circumstances, we may need to cancel a holiday. Where we cancel your holiday, your rights to an alternative arrangement and/or refund will be dealt with in accordance with applicable law and the nature of your booking.
We are not responsible for consequential expenses you incur, such as independently booked flights, trains, additional accommodation or other arrangements, except where we are legally responsible for them.
6. Minimum Numbers
Some holidays require a minimum number of participants in order to operate.
Where a minimum group size applies, this will be stated in the holiday information or booking confirmation.
If minimum numbers are not reached, we may cancel the holiday subject to the notice periods and refund requirements required by applicable law.
We recommend that you do not make non-refundable travel arrangements until the departure has been confirmed as proceeding.
7. Travel Insurance
You are strongly advised to have comprehensive travel insurance appropriate for the holiday you are undertaking.
For overseas trips, we may require you to have appropriate travel insurance as a condition of participation.
You are responsible for ensuring that your insurance provides adequate cover for your individual circumstances.
8. Fitness, Health and Cycling Ability
Cycling holidays are physically demanding activities and involve inherent risks.
It is your responsibility to read the description and difficulty level of the holiday and satisfy yourself that you have sufficient fitness, cycling ability and experience to participate safely.
You must tell us before departure about any relevant circumstances that may materially affect your ability to participate safely or require reasonable adjustments to your arrangements.
If you are uncertain about your ability to participate, you should seek appropriate professional advice before booking or travelling.
Our guides may modify a route or ask a participant to stop riding where, acting reasonably, they consider that continuing would create a significant safety risk to that participant or other members of the group.
9. Participant Responsibilities
You are responsible for riding in a safe and responsible manner and complying with applicable road traffic laws, local regulations and reasonable safety instructions given by our guides.
Unless expressly stated otherwise, roads used during our holidays are not closed to traffic.
You remain responsible for your own decisions while cycling, including your speed, road position and whether you consider it safe to ride a particular section.
Participants must not ride while impaired by alcohol, illegal drugs or any substance that makes it unsafe for them to cycle.
Helmets must be worn while cycling on all organised rides.
10. Group Conduct
We want our holidays to be enjoyable and safe for everyone.
We reserve the right to refuse participation or require a participant to leave a holiday where their behaviour is dangerous, abusive, seriously disruptive, unlawful or presents a material risk to themselves or others.
Where a participant is required to leave for these reasons, we will not normally be responsible for their additional travel, accommodation or other costs, subject always to applicable law.
11. Your Bicycle and Equipment
If you bring your own bicycle, you are responsible for ensuring that it is safe, roadworthy and suitable for the terrain and distances described for the holiday.
You are responsible for maintaining your bicycle and equipment throughout the trip.
Where practical, our guides may assist with minor mechanical problems, but this cannot be guaranteed and does not make us responsible for the maintenance or condition of your bicycle.
You are responsible for loss of or damage to your own bicycle, luggage and personal equipment except where the loss or damage results from our negligence or where we otherwise have legal responsibility.
12. Hire Bikes
Bicycle hire is not included in the price of your booking.
Where we arrange bicycle hire on your behalf, you will be responsible for paying the applicable hire charges. Separate terms and conditions may apply to the bicycle hire.
You must inspect your hire bicycle when it is supplied and notify us or the hire provider promptly of any apparent defects.
You are expected to take reasonable care of all hired bicycles and equipment.
You may be responsible for loss or damage caused deliberately or through negligence or misuse, subject to the terms of the relevant hire agreement and applicable law.
13. Routes, Weather and Riding Conditions
Published routes, distances, elevations and itineraries are intended as a guide and may change.
Cycling is particularly affected by weather, road conditions, traffic, closures, landslides, flooding, snow, heat and other local circumstances.
Our guides may shorten, alter, substitute or cancel a ride where they reasonably consider this necessary for safety or operational reasons.
Where reasonably possible, we will provide a suitable alternative.
14. Accidents and Emergencies
Cycling carries inherent risks including falls, collisions, road traffic accidents, changing road surfaces, weather conditions and the actions of other road users.
You acknowledge these ordinary risks when choosing to participate.
In the event of an accident or emergency, you agree that we may take reasonable steps to obtain medical or other assistance where necessary.
Nothing in these Terms & Conditions excludes or limits liability which cannot legally be excluded or limited, including liability for death or personal injury caused by our negligence.
15. Accommodation
Accommodation will be as described in your itinerary or booking information.
Occasionally it may be necessary to substitute accommodation because of circumstances outside our reasonable control. Where this happens, we will endeavour to provide accommodation of a similar standard where reasonably possible.
Room configurations and facilities may vary between locations.
Any additional expenses incurred at accommodation, including minibar charges, laundry, room service, damage or other personal expenditure, are your responsibility.
16. Meals and Dietary Requirements
Where meals are included, this will be stated in the holiday description.
Please tell us about dietary requirements when booking. We will pass reasonable requests to the relevant providers but cannot guarantee that every dietary requirement can be accommodated.
Participants with serious allergies should make appropriate enquiries before travelling and should not assume that an environment will be allergen-free.
17. Passports, Visas and Travel Requirements
For overseas holidays, you are responsible for ensuring that you have a valid passport and any necessary visas, permits, health documentation and other entry requirements.
You are also responsible for complying with the immigration, customs and entry requirements applicable to your nationality and circumstances.
We are not responsible for costs arising because a participant cannot travel due to inadequate or incorrect documentation where we have not caused the problem.
18. Travel to and from the Holiday
Unless expressly included in the holiday description, transport to the starting point and from the finishing point of the holiday is your responsibility.
You should allow sufficient time for connections and unforeseen delays.
Where flights, trains or other transport have been booked independently by you, your arrangements with those providers are separate from your booking with us unless expressly stated otherwise.
19. Luggage and Personal Property
You are responsible for your personal belongings throughout the holiday.
You should not leave valuable items unattended and should ensure that bicycles are appropriately secured whenever necessary.
We recommend that appropriate insurance is obtained for bicycles, luggage, electronic devices and other valuable items.
20. Third-Party Suppliers
We may use hotels, restaurants, transport providers, bicycle hire companies and other independent suppliers in providing elements of your holiday.
Those suppliers may have their own reasonable terms and conditions which apply to the services they provide.
Nothing in this section reduces any responsibility we have to you under applicable package travel or consumer law.
21. Unavoidable and Extraordinary Circumstances
Events may occur which are outside our reasonable control. These may include, for example, severe weather, natural disasters, war or serious security incidents, government action, significant transport disruption, epidemics or other events whose consequences could not reasonably have been avoided.
Where such circumstances affect your holiday, your rights and our obligations will depend upon the circumstances and applicable law.
Where the Package Travel and Linked Travel Arrangements Regulations 2018 apply, nothing in these Terms & Conditions affects the rights provided to travellers by those Regulations.
22. Prices
The price and services included in your holiday will be stated at the time of booking.
Any optional extras or services not expressly stated as included are payable separately.
Any right to change the price after booking will only be exercised where permitted by applicable law and where the booking terms provided to you allow us to do so.
23. Complaints
If you experience a problem during your holiday, please tell your guide or our representative as soon as reasonably possible so that we have an opportunity to resolve it.

We will investigate the matter and respond as soon as reasonably practicable.
24. Photographs and Marketing
We may take photographs or video during our holidays.
We reserve the right to use these materials for promotional or marketing purposes. If you do not wish to appear in promotional photographs or video, please tell us.
25. Personal Information
We will process personal information in accordance with our Privacy Policy and applicable data protection law.

We may need to share relevant information with hotels, transport operators, bicycle hire providers and other suppliers where necessary to provide your holiday.
26. Applicable Law
These Terms & Conditions and your booking are governed by the applicable laws of England and Wales, subject to any mandatory consumer rights that apply to you.
Nothing in these Terms & Conditions affects your statutory rights.
